The American Gaming Association has officially entered the legal battle between New Jersey and Kalshi. The industry group filed a brief asking the United States Supreme Court to review a lower court ruling. That previous decision stopped New Jersey from enforcing state gambling laws against Kalshi sports event contracts.
The core legal question
The main dispute centers on whether federal commodity laws override state authority over sports gambling. New Jersey wants the highest court to decide if federal registration frees these prediction markets from local rules. Traditional bookmakers argue that sports contracts are simply bets under another name.
Unfair competition concerns
Licensed sportsbooks must pay taxes and follow strict consumer protection laws set by state and tribal governments. Prediction markets currently operate nationally without meeting those exact licensing requirements. Traditional operators claim this creates an unfair advantage in the regulated market.
Growing political support
A large group of state attorneys general also backed the legal petition from New Jersey. They argue that traditional gambling regulation belongs to the states to protect the public. The National Football League joined them by raising worries about sports integrity safeguards.
Punters might see big changes to where and how prediction markets offer sports wagers if the Supreme Court takes the case.
