New York is trying to force prediction market Kalshi to hand over internal documents in an ongoing legal fight.

New York state officials are stepping up legal pressure on prediction markets by targeting the exchange Kalshi. The state attorney general filed a petition asking a court to order the company to produce documents. This follows a subpoena issued in September that asked for extensive business records.
The core of the legal dispute
State officials argue that Kalshi operates an unlicensed gambling business that breaks local laws. Kalshi counters this claim by stating that federal regulators under the Commodity Futures Trading Commission should oversee its operations. A federal judge previously rejected a request by Kalshi for an injunction against the state.
What the subpoena demands
The subpoena covers a wide range of company records including influencer marketing and advertising agreements. It also asks for details on proprietary trading, market making, and incentive programs for high volume users. Kalshi missed the October deadline to provide these materials and instead moved to quash the request in court.
Broader regulatory crackdown
New York is also pursuing other major prediction market providers with similar allegations of unlicensed gambling. While this legal battle continues in federal and state courts, the federal agency has ordered Kalshi to keep offering its contracts. Both sides continue to fight over who holds the legal authority to regulate these markets.
The ongoing legal battles between states and prediction markets could change how alternative betting products are regulated across the country.
